Photo & Video Service Terms & Delivery Policy

1. Delivery of Materials

After booking a service, the client receives an invoice. Payment must be made by the due date stated on the invoice.

Final photographs and video materials are delivered after completion of the work and full payment of the agreed services.

The estimated delivery period is 2–6 weeks from the date of the shoot, depending on the scope of work, project complexity and the current workload of the service provider.

Materials are delivered electronically via cloud storage (such as Google Drive) or by another agreed delivery method.

2. Quantity of Delivered Materials

The number of photographs, amount of video footage, duration of the final video and format of the final deliverables are determined individually and agreed upon before the shoot.

Where the client requests a specific number of photographs, volume of footage or final video duration, the service fee may be adjusted according to the scope of shooting, selection, editing and post-production work required.

If the number of photographs, amount of footage or duration of the final video has not been agreed in advance, the service provider shall determine the quantity of delivered materials at their sole professional discretion, taking into account the nature of the event, shooting conditions and professional judgment.

The service provider does not guarantee any specific number of photographs, clips, minutes or seconds of footage unless expressly agreed in writing before the shoot.

3. Selection and Editing

The photographer or videographer is solely responsible for selecting the final materials.

The service provider independently removes technically unsuccessful images, duplicate files, test shots, photographs with closed eyes, unsuitable facial expressions, defective images and any materials that do not meet professional quality standards.

All delivered photographs and videos undergo basic editing.

Basic editing may include color correction, exposure adjustments, cropping, horizon alignment, video stabilization, basic contrast and brightness adjustments and other standard technical improvements.

The final artistic style is determined by the service provider based on professional experience, artistic style and creative judgment.

4. Additional Retouching and Advanced Editing

Basic editing is included in the service fee unless otherwise agreed.

Advanced retouching, including but not limited to skin retouching, hair retouching, clothing retouching, environmental adjustments, object removal or replacement, photo manipulation, compositing, background replacement, body reshaping, detailed color grading, advanced video graphics, visual effects (VFX), removal of unwanted elements from video footage and any other work beyond standard editing, shall be considered an additional service.

Additional retouching and advanced editing may be ordered either before the shoot or after the client has received the photographs or video materials with basic editing applied.

The scope, delivery time and pricing of such additional work shall be agreed separately.

The service provider reserves the right to charge for additional retouching and advanced editing based on the actual time required to complete the work.

5. RAW Files and Original Materials

RAW photographs, original video footage and other working materials are not included in the standard service package and are not delivered to the client.

Original materials may be delivered only if agreed separately in writing before the shoot.

If the delivery of RAW files, original video footage or other working files has not been agreed in advance, the service provider has no obligation to provide such materials.

6. Workflow

The service provider independently determines shooting methods, equipment, technical settings, editing techniques, selection criteria, production methods and the overall workflow.

The client does not participate in the selection, editing, retouching, post-production or preparation of materials unless otherwise agreed in writing before the shoot.

7. Equipment Failure

In the event of equipment malfunction during a shoot, including but not limited to cameras, lenses, lighting equipment, storage media, audio recording devices or other technical equipment, the service provider shall not be liable for indirect damages, loss of income, loss of profit or any other financial claims.

In such circumstances, the service provider shall arrange a replacement shoot for the project or the affected part of the project on a new mutually agreed date.

A replacement shoot shall be considered the sole remedy for technical equipment failure unless otherwise agreed in writing between the parties.

8. Force Majeure

If the shoot cannot be carried out due to illness of the service provider, accident, natural disaster, technical failure beyond reasonable control, government restrictions, war, transportation disruptions or any other circumstances beyond the reasonable control of the service provider, the client shall have the right to either:

  • receive a full refund of any booking deposit already paid; or
  • reschedule the shoot to another mutually agreed date without additional charges.

The service provider shall not be liable for failure to perform obligations caused by force majeure or circumstances beyond reasonable control.

9. Copyright and Usage Rights

All copyrights to photographs, video materials and other creative works produced by the service provider remain the exclusive property of the service provider unless otherwise agreed in writing.

The client receives a non-exclusive licence to use the delivered materials solely for the agreed purposes.

Delivery of photographs, video materials or any other files does not constitute a transfer of copyright ownership.

The client may not sell, sublicense, transfer to third parties, use for resale, artificial intelligence training, derivative works or any other commercial purposes without prior written consent of the service provider unless expressly agreed otherwise.

The service provider retains the right to use the created materials in portfolios, websites, social media, advertising materials, competitions and professional publications unless otherwise agreed in writing before the shoot.

Upon written request, the parties may separately agree on a confidential shoot where the materials will not be published by the service provider.

10. Limitation of Liability

The maximum liability of the service provider for any claim shall be limited to the total amount paid by the client for the relevant service.

The service provider shall not be liable for indirect damages, loss of profit, loss of business opportunities, reputational damage or any other consequential losses arising from the use or inability to use the delivered materials.

11. Cancellation Policy

If a booking is cancelled after confirmation, the client shall pay 50% of the agreed service fee as compensation for the reserved working time.

If a booking deposit has already been paid, the deposit may be applied toward this compensation.

Rescheduling a shoot shall be considered separately and shall not automatically be treated as a cancellation if both parties agree to a new date.

Payment of a booking fee, deposit or invoice constitutes acceptance of these Terms and Conditions.
